By accessing and using Santhai ("the Platform"), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree with any part of these terms, you must not use the Platform. These terms apply to all users, including buyers, sellers, advertisers, and visitors.

2. Account Registration

To access certain features of the Platform, you must create an account and verify your email address via OTP. You agree to:

3. Buying on Santhai

When you purchase a product, you enter into a contract directly with the seller. Santhai acts as a marketplace platform and is not a party to the transaction between buyers and sellers. We do not guarantee the quality, safety, or legality of items listed for sale.

• Product descriptions, images, and pricing are provided by sellers and may vary
• Delivery times, shipping costs, and product availability depend on the seller
• Review products and seller ratings carefully before making a purchase
• You may contact sellers directly through our messaging system for enquiries

4. Selling on Santhai

Sellers must register an account and may set up a brand profile to list products. By listing products for sale, you agree to:

• Provide accurate product descriptions, images, pricing, and location details
• Fulfil orders promptly and maintain honest communication with buyers
• Not list prohibited items, counterfeit goods, or items that violate any applicable laws
• Comply with all local, state, and national regulations regarding the sale of goods
• Keep product inventory and availability information up to date

Santhai reserves the right to remove listings, suspend seller accounts, or take other appropriate action for violations of these terms.

5. Advertising on Santhai

Registered users may create and publish advertisements on the Platform, subject to the following conditions:

• All ads are subject to approval by Santhai administrators before going live
• Ads must not contain misleading, offensive, or illegal content
• Banner and text ads must comply with the supported size formats provided on the Platform
• Ads may be targeted to specific cities, states, or countries using our location targeting system
• Santhai reserves the right to reject, remove, or deactivate any ad at its sole discretion
• Click metrics and performance data are tracked and may be made available to advertisers
• Featured ad placement is determined by Santhai and may require additional terms

6. Messaging & Communication

Santhai provides an in-platform messaging system for buyers and sellers to communicate. When using this feature, you agree to:

• Use messaging only for legitimate enquiries related to products or orders
• Not send spam, unsolicited promotions, or harassing messages
• Not share personal contact details for the purpose of circumventing Platform fees or policies
• Understand that Santhai may monitor messages to ensure compliance with these terms

7. Payments

All payments are processed through our secure payment system. Prices are displayed in the local currency and may be subject to applicable taxes and shipping fees. By making a payment through the Platform, you agree to:

• Provide valid and authorised payment information
• Pay all charges at the prices in effect when incurred
• Accept that refunds are handled according to our refund policy and seller terms

8. Privacy

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information, including account data, location information, transaction records, and messaging content. By using Santhai, you consent to the collection and use of your information as described therein.

9. User Content

By posting content, you grant Santhai a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content in connection with operating the Platform.

We reserve the right to remove any content that violates these terms, infringes intellectual property rights, or is otherwise objectionable.

10. Intellectual Property

All content on the Platform, including text, graphics, logos, icons, and software, is the property of Santhai or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

The Santhai name, logo, and all related trademarks are the property of Santhai and may not be used without prior written consent.

11. Prohibited Activities

You agree not to:

• Use the Platform for any unlawful or fraudulent purpose
• Post false, misleading, defamatory, or offensive content
• Manipulate product reviews, ratings, or ad click metrics
• Interfere with the proper functioning of the Platform or its infrastructure
• Attempt to gain unauthorised access to other accounts, systems, or data
• Scrape, crawl, or harvest data from the Platform without permission
• Engage in spamming, phishing, or other malicious activities
• Circumvent any security features, access controls, or usage limits
• Use bots or automated tools to interact with the Platform without authorisation

12. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Santhai does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not endorse or guarantee any products, services, or advertisements listed on the Platform.

13. Limitation of Liability

To the fullest extent permitted by law, Santhai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Santhai, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these terms, or your infringement of any third-party rights.

15. Termination

• You remain liable for any outstanding obligations incurred prior to termination

You may also delete your account at any time by contacting us. Certain data may be retained as required by law or for legitimate business purposes.

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts in India.
